Terms and Conditions

1.- Introduction:
The purpose of this document is to regulate the GENERAL TERMS or CONDITIONS OF PROCUREMENT of the Booking and Online Booking services (hereafter, and interchangeably, ‘Booking’ and ‘Online Booking’ services, or ‘services’) of Casa Kala, managed by Penguin Harmony UDA with registered offices at Rua da Firmeza 138, 4000-225, Porto, Portugal, and Tax ID number 516419455. (hereafter, ‘Casa Kala’ or ‘The Guesthouse”), Tel. +351 967 566 637. The terms “You”, “User” and “Guest” are used here to refer to all individuals and/or entities who for whatever reason access the website CasaKala.com, or Casa Kala’s booking engine from cloudbeds.com, or use its services.The use of these services implies full and unconditional acceptance and validity of each and all the General Terms and/or Conditions – which are deemed to be automatically incorporated into the contract concluded with Casa Kala, without the need for your written transcription in the same – included in the latest version of these General Terms and/or Conditions. 
2.- Use of the Casa Kala Booking Services:
Booking Services: The online booking services are for informational purposes only, and are designed to allow the Guest to check the availability of rooms at Casa Kala. The Guest is aware of any restrictions that may apply to certain services or areas of the property before making a booking. The Guest will receive an email confirmation within 24 hours, and the booking will become binding only after Casa Kala has accepted the reservation, confirmed by email and payment by the Guest. The Guest must verify the booking confirmation and immediately notify Casa Kala in writing of any errors.
Online Booking Services:The purpose of the Online Booking services is for the reservation of a room in Casa Kala. THE USE OF THESE SERVICES IMPLIES FULL AND UNCONDITIONAL ACCEPTANCE AND VALIDITY OF EACH AND ALL THE GENERAL TERMS AND/OR CONDITIONS – WHICH ARE DEEMED TO BE AUTOMATICALLY INCORPORATED INTO THE CONTRACT CONCLUDED WITH CASA KALA, WITHOUT THE NEED FOR YOUR WRITTEN TRANSCRIPTION IN THE SAME – INCLUDED IN THE LATEST VERSION OF THESE GENERAL TERMS AND/OR CONDITIONS.
External Service Providers and Links: The site provides access to services and information from external websites that are outside the control of Casa Kala. Users accessing these sites through the links provided on the website should be aware of the specific terms and conditions of use stipulated by the respective operators. Casa Kala is not responsible for the accuracy of the contents, information or links provided by these external websites, and cannot be held liable for any errors or omissions in such information or for any failure to update it. Any user wishing to verify the accuracy of the information provided by these websites should access them directly. 
3.- Reservations:
Minimum Age: Guests must be at least 18 years of age to make a reservation and check-in to the Guesthouse.
Casa Kala does not accommodate guests under the age of 16 for overnight stays.
Special Requests: We will do our best to accommodate any special requests from guests, but please note that availability cannot be guaranteed and additional fees may apply.
Occupancy: Rooms have a maximum occupancy of two people.
Room Category: Casa Kala guarantees the availability of a room in the category reserved, but not a specific room within the Guesthouse.
Taxes: All reservations are subject to a 2 Euro tourist tax per person per night, as collected by the Portuguese authorities. The prices shown at the time of booking include VAT and 2 Euro Tourist tax, unless stated otherwise.
Reassignment of Rooms: In the event that the Guest does not arrive on the scheduled date, the room may be reassigned. The full amount of the stay will still be charged and the reservation will no longer be guaranteed. The Guesthouse reserves the right to reassign the room to another guest after the day of arrival. The Guest is responsible for ensuring their timely arrival and any reassignment of rooms will not result in a refund. 
4.- Rates and Cancellation Policies:

The price of the stay to be paid by the Guest constitutes the compensation for making the room available for use during the period between arrival and departure. Room rates are subject to change without prior notice. The prices shown at the time of booking include VAT, unless stated otherwise.The Guesthouse and accommodation characteristics described in the booking may not match the actual conditions at the time of the guest's stay. However, any differences between the photos and reality do not give the guest the right to make changes to the contract. The meal plans and their specifics will be communicated to theguest through the website at the time of booking. If the booking does notmention a meal plan, it is assumed that no meals are included. The total price of the stay will be charged per night, regardless of whether the Guest actually uses the room or stays there overnight.In the case of a no-show, the total cost of the reservation willbe charged and is non-refundable.Cancellation and prepayment policies vary based on the type ofaccommodation. The guest should check the specific conditions that may applywhen making their selection.  Please note that cancellation policies may vary on third-party booking platforms such as Airbnb, Booking.com, VRBO, Expedia, Orbitz, etc.   
4.1.- Non-refundable Rate:
Prepayment: Payment for the total cost of the reservation is required at the time of booking and is non-refundable.
Accepted Methods: Guests can make payment online using a credit card or debit card, or paypal.
Cancellations: Cancellations are not permitted for non-refundable reservations and no refunds will be issued.
No-shows: In the event of a no-show, the total cost of the reservation will be charged and no refunds will be issued.
Early Departure: If the guest leaves prior to the scheduled departure date, the total cost of the reservation will be charged and no refunds will be issued.By making a reservation, guests acknowledge and accept these terms and conditions.Please note that by making a non-refundable booking guests accept that the payment will be charged to the credit card at the time of booking, and that no cancellations, changes or refunds are allowed.
4.2.- Flexible Rate up to the 8th day before check in:
Payment: Payment for the total cost of the reservation is required at the time of booking.
Accepted Methods: Guests can make payment online using a credit card, debit card or paypal.
Flexible cancelation: For cancellations made 8 or more days prior to arrival, a full refund will be issued, minus a 5% processing fee of the total reservation cost. If you cancel within 7 days before your check-in date, you will be charged the full cost of the reservation. Please note that cancellations must be submitted at least 8 days prior to the check-in date. Cancellations made after this deadline will result in a charge equal to the full cost of the reservation.
No Shows: In the event of a no-show, the total cost of the reservation will be charged.
Early Departure: If the guest leaves prior to the scheduled departure date, the total cost of the reservation will be charged.Additional Terms and Conditions may apply. 
5.- Check-in and Check-out:
Check-in: Our check-in process is contactless and typically takes place between 3:00 PM and 9:00 PM. If you require a different check-in time, please let us know in advance.48 hours prior to your arrival date, we will provide you with an access code and your room name/number. This unique code will give you access to the main gate, the building, and your room.Our team will welcome you in person and check you in during breakfast hours (8:00 AM - 10:30 AM) the following morning. For guests arriving before 3:00 PM, the main gate and building will be accessible, but your room will only be accessible with the access code after 3:00 PM. Guests are welcome to use the common areas while they wait for their room to be available. Guests may store their luggage in the locker area at their own risk.
Check-out: Check-out time is at 11:00 AM.
Payment: All outstanding charges must be settled upon check-out.
Damages: Guests are responsible for any damages to the room or property during their stay.
Lost or Damaged Items: Guests are responsible for any items left behind in their room. Casa Kala will make reasonable efforts to return items but is not responsible for lost or damaged items.
Return of key or access code: Please leave the card key inside the card reader next to the door of your room.
Feedback: We would love to hear from your experience. As a family-owned business, we highly value the feedback and opinion of our guests. Positive reviews are important to us as they help us to improve our services and attract new guests. We kindly ask guests to take a moment to share their experience with us, whether through online review platforms, social media or through our website.
6.- Occupancy:

The room rate is based on double occupancy.
7.- Breakfast:

When stipulated in the booking information, Breakfast is included in the daily rate. Casa Kala offers a continental breakfast, which is served in our common room from 8:00 AM to 10:30 AM. The breakfast includes a variety of breads, pastries, cereals, fruits, yogurts, cheese and cold cuts, eggs prepared to your liking as well as coffee, tea, and juice.Guests with special dietary needs can let us know in advance, and we will do our best to accommodate them.
8.- Internet:

We offer complimentary wireless internet access (WiFi) in all guest rooms and common areas. The WiFi codes can be found on the framed information located next to the door inside your room.Please note that while we strive to provide a seamless internet experience, Casa Kala does not guarantee the speed, availability, orreliability of the internet service and shall not be held responsible for any interruptions or service issues. It is the responsibility of the guests to ensure that their deviceand internet security measures are up-to-date. The use of the internet servicemust be in accordance with all applicable laws and regulations, and any illegalor unethical online activities are strictly prohibited. The Guesthouse reservesthe right to limit or restrict internet usage for guests who engage in illegalactivities or activities that violate our policies or harm the property’snetwork. 
9.- Housekeeping:

Daily light refreshment service is offered for guest rooms and includes making the bed and tidying up.  Full housekeeping service, which includes cleaning, vacuuming, and changing bed linens, is provided every third day.  Fresh towels can be requested at any time.  Special Cleaning Fees may be charged if a room requires excessive cleaning due to neglect or damage, or in case of missing objects. The minimum fee is set at 150 EUR and activities that may result in an excessive fee include smoking, excessive mess, damaging Casa Kala’s property, or bringing in outside food or drinks that cause stains or odors. Casa Kala reserves the right to access the guest's room for necessary maintenance or housekeeping tasks
10.- Parking:

Parking is not available on the premises.Street parking on Rua da Firmeza is available at a cost of 1.20 EUR per hour with a maximum of 2 hours and can be paid for locally or via the "Estationar" app from Via Verde. There are also several nearby parking facilities.  Casa Kala is not responsible for any damage or loss to vehicles or their contents while parked on the street or in nearby parking facilities.

Casa Kala has reserved parking spaces at a nearby parking facility, Parking Bella Vista, for the convenience of our guests. Please note that the availability of parking spaces is subject to availability and is allocated on a first-come, first-served basis. Guests who wish to reserve a parking space must send an email to Casa Kala prior to their arrival. The reservation is considered confirmed only upon receipt of a confirmation email from Casa Kala.

The parking fee is 15 EUR per night and is payable at the reception upon check-in. Payment can be made in cash or by card.

The reserved parking space is valid from 3 pm on the day of arrival until 11:30 am on the day of check-out. Guests must ensure that their vehicle is removed from the parking space by the designated check-out time to avoid any additional charges.

Guests will be provided with a remote control for accessing the parking facility. It is the responsibility of the guest to securely and safely handle the remote control during their stay. In the event of loss or damage to the remote control, a replacement fee of 50 EUR will be charged.

Casa Kala assumes no responsibility for any damage, theft, or loss of personal property or vehicles parked in the designated parking space. Guests are advised to lock their vehicles and keep valuable items out of sight. The parking facility is managed independently of Casa Kala. Guests are expected to comply with all rules and regulations of the parking facility during their stay. Any violations or fines incurred while using the parking facility are the sole responsibility of the guest.

Casa Kala reserves the right to revoke or modify parking reservations in exceptional circumstances, such as emergencies or unforeseen events. In such cases, Casa Kala will make reasonable efforts to provide alternative parking arrangements or assist guests in finding suitable parking alternatives.

By reserving a parking space at Casa Kala, guests acknowledge and accept these terms and conditions, and agree to abide by all parking regulations and policies.

11.- Pets:

Pets are not allowed.Animals brought into the property by a Guests gives Casa Kala the right to immediately terminate the contract and ask the guest to leave without reimbursement.
12.- Bringing Food and Beverage:

Cooking is not allowed in the room or any other are of the property.Storing or consuming food or beverage in the room is not permitted for health and safety reasons.
13.- Smoking:

Casa Kala is a non-smoking facility.Smoking is is strictly prohibited in any guest rooms or common areas.Smoking is only permitted in designated outdoor smoking areas.Any violations of this policy will result in a 250 EUR room cleaning fee, to cover the costs of removing smoke odor and any related damages.
14.- Noise:

Guests are required to maintain a reasonable noise level at all times, in both guest rooms and common areas. Any excessive noise that disrupts other guests or staff will not be tolerated. In cases of violations, guests may be asked to lower the noise or, in extreme cases, asked to leave, resulting in an immediate termination of the contract without reimbursement. Your cooperation in creating a peaceful environment for all guests is appreciated.

15.- Liability:

Casa Kala shall not be held responsible for any loss or damage to guests' personal belongings or for damages or accidents in the room or any part of the property unless such loss, damage, or accident was caused by its culpable actions. Casa Kala cannot be held liable for the acts or omissions of any other guests. Any damage caused to third parties by guests is the sole responsibility of said guests and shall not imply any liability to Casa Kala. The guests are expected to take reasonable precautions to protect their personal belongings while on the property. 
16.- Force Majeure:

Casa Kala will not be held responsible for any failure to perform its obligations under these terms and conditions due to events beyond its control, including but not limited to acts of nature, war, terrorism, strikes, pandemics, government action, or any other cause beyond Casa Kala's reasonable control. In such cases Casa Kala may terminate the contract without any liability.
17.-Obligations of the Guest Regarding the Use of Services:

The Guest agrees to use the services offered by Casa Kala in accordance with all relevant laws, ethical standards, and terms and conditions outlined in these General Terms and Conditions.Casa Kala may immediately terminate the accommodation contract for serious reasons such as being under the influence of drugs or alcohol, engaging in any illegal activities in the property, offending staff or other guests, disturbing the peace, making false reservations, or damaging property or the reputation of the establishment.
18.- Privacy:

Casa Kala respects the privacy of its guests and is committed to protecting any personal information collected during the guests' stay. Personal information will only be used for fulfilling guest’s requests, such as processing reservations and providing information about the services. Casa Kala will not share or sell any personal information to third parties, except as required by law or if deemed necessary for the performance of the contract through selected service providers.Guests have the right to access, modify and delete their personal information.
19.- Right to Modify the General Terms and Conditions:

Casa Kala reserves the right to modify, update or change at any time and without prior notice, the services provided, the operational or technical conditions, and the conditions of use of the services for increased efficiency and the benefit of its guests. It is the responsibility of guests to periodically review the Terms and Conditions to stay informed of any changes. Casa Kala will not be liable for any inconvenience or loss suffered by guests as a result of modifications to the services or conditions.
20.- Governing Law:

These terms and conditions shall be governed by and construed in accordance with the laws of Portugal.
